AEROTEST OPERATIONS INC. - NRC RESPONSE TO AEROTEST RE:

CONFIRMATORY ACTION LETTER NO. NRR-2011-001

Dear Mr. Brisighella:

On November 29, 2011, the NRC received a status letter report from your counsel, Mr. Robert B. Haemer of Pillsbury Winthrop Shaw Pitman LLP, and an affidavit attached thereto, signed by Mr. Michael S. Anderson, Corporate Secretary, OEA, Inc., in response to our Confirmatory Action Letter (CAL) dated February 26, 2011. On December 9, 2011, a conference call was held with you to seek clarification related to the regulatory process discussed in your letter. In the conference call, you stated that you would like to discuss specific items in your decommissioning plan. Additionally, you stated that you would not be able to meet the December 12, 2011, date as committed by you in response to the CAL. Subsequently, the NRC received two letters from your counsel dated December 12 and 13, 2011, and the affidavits attached thereto, providing additional clarification on your responses to the CAL.

As a result of our review of your letters the NRC requests that you confer with the NRC staff to better understand the status of your efforts in addressing the items in the CAL. In an email dated December 14, 2011, you have agreed to meet at the NRC headquarters on Wednesday, January 18, 2011.

The purpose of the meeting is for Aerotest to discuss with the NRC management and staff the status of the following:

1. Developing a decommissioning plan
2. Developing a decommissioning funding plan
3. Developing a plan to manage and provide funding for the management of the fuel
4. Filing an application for a possession-only license amendment

In accordance with the Commissions Policy Statement on Enhancing Public Participation in NRC Meetings (67 FR 36920) dated May 28, 2002, this will be a Category 1 Meeting. The public is invited to observe this meeting and will have one or more opportunities to communicate with the NRC after the business portion, but before the meeting is adjourned. If you believe that you need to present proprietary information at the meeting, please refer to the regulations in 10 CFR 2.390, Public inspections, exemptions, requests for withholding for additional information.
