Dear Dr. Slaughter:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated November 10, 2020 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20325A134). Your letter relates to my previous letters to you, dated August 31, 2020 (ADAMS Accession No. ML20212L739) and October 23, 2020 (ADAMS Accession No. ML20289A477), in which I affirmed the validity of charges the NRC assessed to Aerotest Operations, Inc. (Aerotest) under Title 10 of the Code of Federal Regulations (10 CFR) Section 170.21, Schedule of fees for production and utilization facilities, review of standard referenced design approvals, special projects, inspections and import and export licenses. These charges appeared within invoice LFB 20-1849, dated January 15, 2020. In your letter, you state that if these charges are considered final, then you would like to appeal the decision to the next level.
The decision provided in my previous letters is the NRCs final response to your fee dispute. My previous letters provided the rationale for that decision. To reiterate, as stated in my October 23, 2020, letter, I consider this matter closed.
There are no provisions within 10 CFR Part 15, Debt Collection Procedures, for further appeal of invoice disputes. Therefore, Aerotest is not entitled to any further agency review of this matter.
