AEROTEST OPERATIONS, INC. - CORRECTION OF LETTERS REGARDING CLOSURE OF CONFIRMATORY ACTION LETTER NO. NRR-04-003 AND REVIEW OF PHYSICAL SECURITY PLAN

Dear Dr. Slaughter:

By letter dated January 7, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21004A079), the U.S. Nuclear Regulatory Commission (NRC) staff notified Aerotest Operations, Inc. (Aerotest) of the approval of the physical security plan (PSP) for the Aerotest Radiography and Research Reactor (ARRR), which Aerotest had submitted by letter dated September 28, 2020 (ADAMS Accession No. ML20276A247). By letter dated January 28, 2021 (ADAMS Accession No. ML21012A201), as a follow-up to the NRC staffs approval of the ARRR PSP, the NRC staff notified Aerotest that it had closed confirmatory action letter No. NRR-04-003, issued February 17, 2004 (ADAMS Accession No. ML033510264), which had formalized commitments to implement site-specific compensatory measures related to security and safeguards.

The NRC staffs letters dated January 7 and 28, 2021, indicated that the approved PSP, which was submitted by Aerotests letter dated September 28, 2020, was post-dated October 1, 2020.

However, the NRC staff subsequently noted that the correct date of the PSP submitted by letter dated September 28, 2020, is also September 28, 2020. Aerotests NRC-approved PSP is therefore the document entitled Security Plan for ARRR, dated September 28, 2020. This letter corrects the October 1, 2020, date provided in the NRC staffs January 7 and 28, 2021, letters.
