AEROTEST OPERATIONS, INC. - U. S. NUCLEAR REGULATORY COMMISSION SECURITY INSPECTION REPORT NO. 05000228/2020202 AND NOTICE OF VIOLATION

Dear Dr. Slaughter:

From August 11-12, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff conducted a security inspection at your Aerotest Radiography and Research Reactor facility. The inspection results were discussed on August 12, 2020. The enclosed report documents the inspection results.

The inspection examined activities conducted under your license as they relate to security and compliance with the Commissions rules and regulations and compliance with the conditions of your license. The inspector reviewed selected procedures and records, observed activities, and interviewed personnel.

Based on the results of this inspection, the NRC has determined that a Severity Level IV violation of NRC requirements occurred. The violation was evaluated in accordance with the NRC Enforcement Policy. The current Enforcement Policy is included on the NRCs Web site at https://www.nrc.gov/about-nrc/regulatory/enforcement/enforce-pol.html. The violation is cited in the subject Notice of Violation (Notice) (non-public) and the circumstances surrounding it are described in detail in the subject inspection report. The violation is being cited in the Notice because it constitutes a failure to meet regulatory requirements that has more than minor security significance and the licensee failed to identify the violation.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) Section 2.390, Public inspections, exemptions, requests for withholding, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs document system (Agencywide Documents Access and Management System (ADAMS)). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).

Enclosure transmitted herewith contains Official Use Only - Security Related Information. When separated from the enclosure, this transmittal document is decontrolled. However, the Notice and inspection report contain Security-Related Information in accordance with 10 CFR 2.390(d)(1) and disclosure to unauthorized individuals could present a security vulnerability. Therefore, a copy of the Notice and inspection report will not be made available electronically for public inspection in the NRC Public Document Room or ADAMS.

You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. If you have additional information that you believe the NRC should consider, you may provide it in your response to the Notice. The NRC review of your response to the Notice will also determine whether further enforcement action is necessary to ensure compliance with regulatory requirements. If Security-Related Information is necessary to provide an acceptable response, please mark your entire response Security-Related Information in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response. If Safeguards Information is necessary to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21, Protection of Safeguards Information: Performance requirements.
