Dear Don:

As you know, the first deadline for submission of our preliminary draft for Chapters 1, 2 and 3 of the Environmental Statement for the New Haven Nuclear project is May 16, 1979. I wish to advise you that staff believes that it is undesirable to meet that deadline and the subsequent schedule put forth in Appendix 2 of the NRC-DPS-DEC agreement.

I believe it is in our best interest, and yours, to incorporate the electric demand forecast of the New York State Energy Planning Board which will become available in the New York Energy master plan late in 1979 and will be binding on the Siting Board. The staff is therefore preparing a schedule, to be filed soon with the NRC and the State Siting Board, which calls for the completion of the New Haven case in two years and six months. This proposal would lengthen the time available for the State to provide technical input to the NRC for the Environ-mental Statement by six months. As you recall, the agreement for our services provides that the tentative schedule is intended to meet a requirement that the State proceeding be concluded by January 22, 1981. Since staff of the DPS 19 proposing a longer schedule for the case and our agreement allows us to modify the schedule as long as there is no conflict with State requirements, I rucommend that we develop a new schedule as soon as the State SitAng Board agrees to the two year and six month deadline for this case.

Sells April 26, 1979 My decision to recommend reconsideration of the schedule was also affected by the fact that the staff of the Department of Public Service is reluctant to assume joint hearings absent a response from Chairman Hendrie to Chairman Zielinski's proposal to hold joint hearings. The NRC-DPS-DEC agreement is only effective if there are joint hearings.

As you can appreciate, this was a difficult decision for me since our staff is eager to perform services for the NRC, and in fact has begun preparatory work and will participate in the site visit the week of May 7, but it would be imprudent to go further at this time. When the Siting Board approves the revised deadline and joint hearings are approved, we can establish another schedule that is mutually acceptable.
