SUBJECT:

UNIVERSITY OF CALIFORNIA - IRVINE, NRC SECURITY-RELATED INSPECTION REPORT NO. 50-326/2016-201 AND NOTICE OF VIOLATION

Dear Dr. Gillman:

On March 1-3, 2016, the U.S. Nuclear Regulatory Commission (NRC or the Commission)

conducted a security inspection at your University of California - Irvine Nuclear Research Reactor Facility. The inspection included a review of activities authorized for your facility.

The inspection examined activities conducted under your license as they relate to security and compliance with the Commissions rules, regulations, and orders; implementation of certain compensatory measures; and compliance with the conditions of your license. The inspector reviewed selected procedures and records, observed activities, and interviewed personnel.

Based on the results of this inspection, the NRC has determined that a Severity Level IV violation of NRC requirements occurred. The violation was evaluated in accordance with the NRC Enforcement Policy included on the NRCs Web site at www.nrc.gov; select What We Do, Enforcement, and then Enforcement Policy. The violation is cited in a Notice of Violation (Notice) and the circumstances surrounding it are described in detail in our inspection report.

The violation is being cited in the Notice because it constitutes a failure to meet regulatory requirements that has more than minor safety significance, and the licensee failed to identify the violation.

The NRC has concluded that information regarding the reason for the violation, the corrective actions planned and taken to correct the violation and prevent recurrence were adequately addressed during the inspection and documented in our inspection report. If you choose to provide additional information related to the violation, you should follow the instructions specified in the Notice.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) Section 2.390, Public, inspections, exemptions, requests for withholding, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from NRCs document system (Agencywide Documents Access and Management System (ADAMS)). ADAMS is accessible from the NRC Website at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). However, because of the security-related items contained in the report and in the Notice of Violation, and in accordance with 10 CFR 2.390(d), the report and the Notice will not be made available for public inspection.
