Pursuant to 10 CFR 50.54(bb) and 50.75(f)(3), Dominion Energy Kewaunee, Inc. (DEK).submitted an irradiated fuel management plan (Reference

1) and a preliminary decommissioning cost estimate (Reference 2), respectively, to the Nuclear Regulatory Commission (NRC). These reports were required to be submitted at least five years prior to the expiration of the current KPS license (i.e., by December 21, 2008). Although a license renewal application for DEK has been submitted and accepted for review, this five year requirement remains applicable because the renewed license has not yet been issued.On April 23, 2009, the NRC forwarded a Request for Additional Information (RAI), in the form of eight separate RAI questions, to DEK via electronic mail (Reference 3). Each of the RAI questions and the associated DEK responses are provided as an attachment to this letter.The responses to these NRC RAIs include information which is proprietary in nature.DEK requests this information be withheld from public disclosure in accordance with 10 CFR 2.390. The proprietary version of the DEK response is included as Attachment 1.The requested 2006 site specific cost estimate is included as Attachment
2. The non-proprietary version of the DEK response is included as Attachment 3: The associated application and affidavit for withholding the information is included as Attachment 4.Please contact Mr. David A. Sommers at (804) 273-2823 if you have any questions or require additional information.
