PERRY NUCLEAR POWER PLANT-NRC SECURITY PROBLEM IDENTIFICATION AND RESOLUTI ON INSPECTION REPORT 05000440/2017410

Dear Mr. Hamilton:

On November 17, 2017, the U.S. Nuclear Regulatory Commission (NRC) completed a Problem Identification and Resolution inspection at your Perry Nuclear Power Plant, Unit 1, and the NRC inspector discussed the results of this inspection with Mr. F. Payne and other members of your staff. The results of this inspection are documented in the NRC Inspection Report 05000440/2017007. Based on the results of this inspection, the NRC has identified an issue that was evaluated under the security significance determination process as having very low security significance (Green). The NRC has also determined that a violation is associated with this issue. Because you have initiated corrective actions to address the issue, this violation is being treated as a Non-Cited Violation (NCV), consistent with Section 2.3.2a of the Enforcement Policy. Since this issue is security-related, the NCV is described in the enclosed Official-Use-Only inspection report. If you contest the violation or significance of the NCV, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001; with copies to the Regional Administrator, Region III; the Director, Office of Enforcement; the Director, Office of Nuclear Security and Incident Response; and the NRC resident inspector at the Perry Nuclear Power Plant.

If you disagree with the cross-cutting aspect assignment in this report, you should provide a response within 30 days of the date of this inspection report, with the basis for your disagreement, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001; with copies to the Regional Administrator, Region III, and the NRC Resident Inspector at Perry Nuclear Power Plant.

Enclosure contains Sensitive Unclassified Non-Safeguards Information. When separated from enclosure, this transmittal document is decontrolled. This letter will be made available for public inspection and copying at http://www.nrc.gov/reading-rm/adams.html and at the NRC Public Document Room in accordance with 10 CFR 2.390, "Public Inspections, Exemptions, Requests for Withholding." However, the enclosed report contains Security-Related Information, so the enclosed report will not be made publically available in accordance with 10 CFR 2.390(d)(1). If you choose to provide a response that contains Security-Related Information, please mark your entire response "Security-Related Information-Withhold from public disclosure under 10 CFR 2.390" in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). The NRC is waiving the affidavit requirements for your response in accordance with 10 CFR 2.390(b)(1)(ii).
