PERRY NUCLEAR POWER PLANT UNIT 1 - NOTICE OF AVAILABILITY OF THE DRAFT SUPPLEMENT 61 TO THE GENERIC ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWAL OF NUCLEAR PLANTS (EPID NUMBER: L-2023-LNE-0002) (DOCKET NUMBER: 50-440)
Dear Rod L. Penfield:
The U.S. Nuclear Regulatory Commission (NRC) staff has prepared Generic Environmental Impact Statement for License Renewal of Nuclear Plants, Supplement 61, Regarding Perry Nuclear Power Plant, Unit 1, Draft Report (NUREG-1437) (DSEIS). The DSEIS includes the NRC staffs evaluation of the environmental impacts of the license renewal (LR) issues applicable to Perry Nuclear Power Plant, Unit No. 1 (Perry Plant). The DSEIS considers information contained in Vistra Operations Company LLCs (VistraOps), formally Energy Harbor Nuclear Corp., July 3, 2023, submittal (Agencywide Documents Access and Management System (ADAMS) ML23184A081). The NRC staff prepared the DSEIS in accordance with NRC regulations and federal law.
The NRC staff has prepared a Federal Register Notice (FR) of Availability to advise the public that the DSEIS is publicly available in ADAMS at ADAMS accession number ML24241A256.
ADAMS is accessible from the NRC website at https://www.nrc.gov/reading-rm/adams.html. In addition, the draft site-specific EIS will be available to the public near the site at the Perry Public Library, 3753 Main St, Perry, OH 44081.
Based on the staffs evaluation in the DSEIS, the NRC staffs preliminary conclusion is there are no environmental reasons for energy-planning decisionmakers to prevent Perry Nuclear Power Plant, Unit No. 1 to continue to operate for an additional 20 years. The NRC staff based its recommendation on the following: 1) VistraOps environmental report; 2) the NRC staffs consultation with Federal, State, Tribal, and local governmental agencies; 3) the NRC staffs independent environmental review; and 4) the NRC staffs consideration of public comments received during the scoping process.

Two virtual public meetings will be held to present an overview of and accept public comments on the draft site-specific EIS supplement. The NRC meeting notices will be published to provide more details about these public meetings.
A separate Notice of Availability of the DSEIS will be placed in the FR through the U.S.
Environmental Protection Agency (EPA). The 45-day public comment period end date is calculated from the date on which the EPA notice is published in the FR, expected September 6, 2024.
