Dear Mr. Goyette:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter ofFebruary 21, 2006, in which you asked President George W. Bush not to approve the license renewal application for the Oyster Creek Nuclear Generating Station (Oyster Creek) and toreplace Oyster Creek with another nuclear plant of a better design. You also expressed concerns about the NRC licensing review and of a permanent spent fuel repository. The NRC is responsible for reviewing the Oyster Creek application in accordance with therequirements in Title 10 of the Code of Federal Regulations (CFR), Part 54, ?Requirements forRenewal of Operating Licenses for Nuclear Power Plants." NRC licensing reviews areconducted to ensure protection of public health and safety and the environment.

Litigation concerning Amergen Energy Company's application to renew the Oyster Creek license is being conducted under the Commission's "Rules of Practice for Domestic Licensing Procedures and Issuance of Orders" as described in 10 CFR Part 2. Under 10 CFR 2.328, NRC hearings, as a general matter, are public. Documents in the Oyster Creek license renewal proceedings are publicly available through theAgencywide Documents Access and Management System (ADAMS), which is accessible via the NRC's Electronic Reading Room at http://www.nrc.gov/reading-rm/adams.html

.Pursuant to the Nuclear Waste Policy Act, the Department of Energy (DOE) is responsible forsubmitting a license application for a high-level waste repository at Yucca Mountain, Nevada.

The NRC is responsible for reviewing that application in accordance with NRC regulations andapplicable laws. Information regarding DOE activities related to Yucca Mountain is available at http://www.ocrwm.doe.gov/ym_repository/index.shtml. I trust this reply responds to your request.Sincerely,/RA/
