Dear Mr. Trice:

This letter refers to two investigations conducted by the U.S. Nuclear Regulatory Commission (NRC) Office of Investigations (OI) at the Holtec Decommissioning International, LLC (HDI)

Oyster Creek Nuclear Generating Station (Oyster Creek). The investigations, which were completed on September 23, 2021, and October 14, 2021, respectively, involved security matters that are considered sensitive information. Therefore, details of the investigations are not included in this letter but are described in the non-public enclosure.

Based on the results of the NRC OI investigations, the NRC staff determined that multiple examples of a Severity Level IV violation of NRC requirements occurred, but that the occurrences did not result from the willful actions of any of the involved individuals. The NRC is treating this violation as a non-cited violation (NCV) consistent with Section 2.3.2.a of the Enforcement Policy. The details of the violation, including the assessment of its significance, are provided in the enclosure. The NRC notes that HDI took immediate corrective actions to address any security-related vulnerability.

You are not required to respond to this letter. However, if you contest the violation or significance of the NCV, you should provide a response within 30 days of the date of this letter, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington DC 20555-0001, with copies to: (1) the Regional Administrator, Region 1, 2100 Renaissance Boulevard, Suite 100, King of Prussia, PA 19406; and (2) the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) Part 2.390 of the NRCs Rules of Practice, a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room and from the NRCs Agency-wide Documents Access and Management System (ADAMS), accessible from the NRC Web site at Enclosure transmitted herewith contains Sensitive, Unclassified, Non-Safeguards Information. When separated from the Enclosure, the transmittal document is decontrolled.
