From:Wilkins, LynneaTo:"McCutchen, Edward L."Subject:Acceptance of Cooper LAR to Adopt NFPA-805 (ME8551)Date:Wednesday, July 25, 2012 10:59:00 AMEd, By letter dated April 25, 2012 (Agencywide Documents Access and Management System(ADAMS) Accession No. ML121220216), as supplemented by a letter dated July 12, 2012,(ADAMS Accession No. ML12202A042) Nebraska Public Power District (NPPD, thelicensee) submitted a license amendment request for Cooper Nuclear Station (Cooper).The proposed amendment request would adopt National Fire Protection Association(NFPA) Standard NFPA-805, a performance-based standard for fire protection for lightwater reactor electric generating plants, as part of its transition to compliance with Title 10of the Code of Federal Regulations Part 50.48(c).

The purpose of this message is to provide the results of the U.S. Nuclear RegulatoryCommission (NRC) staff's acceptance review of this amendment request. The acceptancereview was performed to determine if there is sufficient technical information in scope anddepth to allow the NRC staff to complete its detailed technical review. The acceptancereview is also intended to identify whether the application has any readily apparentinformation insufficiencies in its characterization of the regulatory requirements or thelicensing basis of the plant.

Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), anamendment to the license (including the technical specifications) must fully describe thechanges requested, and following as far as applicable, the form prescribed for originalapplications. Section 50.34 of 10 CFR addresses the content of technical informationrequired. This section stipulates that the submittal address the design and operatingcharacteristics, unusual or novel design features, and principal safety considerations.

The NRC staff has reviewed your application, as supplemented, and concluded that itdoes provide technical information in sufficient detail to enable the NRC staff to completeits detailed technical review and make an independent assessment regarding theacceptability of the proposed amendment in terms of regulatory requirements and theprotection of public health and safety and the environment. If additional information isneeded for the staff to complete its technical review, you will be advised by separatecorrespondence.
