~l,J4 St.LucieUnits1and2DocketNos.50-335and50-389ProposedLicenseAmendmentFireProtectionTechnicalSecificationsATTACHMENT5DETERMINATIONOFNOSIGNIFICANTHAZARDSCONSIDERATIONThestandardsusedtoarriveatadeterminationthatarequestforamendmentinvolvesanosignificanthazardsconsiderationareincludedintheCommissionsregulation,10CFR50.92,whichstatesthatnosignificanthazardsconsiderationsareinvolvediftheoperationofthefacilityinaccordancewiththeproposedamendmentwouldnot(1)involveasignificantincreaseintheprobabilityorconsequencesofanaccidentpreviouslyevaluated;or(2)createthepossibilityofanewordifferentkindofaccidentfromanyaccidentpreviouslyevaluated;or(3)involveasignificantreductioninamarginofsafety.Eachstandardisdiscussedasfollows:(1)'Operationofthefacilityinaccordancewiththeproposedamendmentwouldnotinvolveasignificantincreaseintheprobabilityorconsequencesofanaccidentpreviouslyevaluated.Theproposedamendmentdoesnotinvolveasignificantincreaseintheprobabilityorconsequencesofanaccidentpreviouslyevaluatedbecausethechangesareadministrativeinnature.TheproposedchangesareinaccordancewiththeguidelinesofGenericLetter88-12whichprovidefortheremovalofthefireprotectionrequirementsfromtheTechnicalSpecificationsinfourmajorareas:firedetectionsystems,firesuppressionsystems,firebarriers,andfirebrigadestaffingrequirements.Theexistingadministrativecontrolrequirementsrelatedtofireprotectionauditswouldberetained.AdditionalprogrammaticrequirementshavebeenretainedorincludedintheadministrativecontrolstoaddresstheFireProtectionProgramequivalenttotherequirementsforotherprogramsimplementedbylicensecondition.(2)Useofthemodifiedspecificationswouldnotcreatethepossibilityofanewordifferentkindofaccidentfromanypreviouslyevaluated.Theuseofthismodifiedspecificationscannotcreatethepossibilityofanewordifferentkindofaccidentfromanypreviouslyevaluatedsincetheproposedchangesdonotinvolveanyphysicalalterationstothefacility,anychangestosetpoints,oranychangestotheoperatingparameters.(3)Useofthemodifiedspecificationwouldnotinvolveasignificantreductioninamarginofsafety.

TheproposedchangestotheOperatingLicensesandTechnicalSpecificationsareconsistentwiththeguidelinesofGenericletter88-12,areadministrativeinnature,andfurtherthegoalofTechnicalSpecificationimprovementasdelineatedinotherNRCpolicystatements.Theproposedchangesdonotdecreasetheleveloffiresafety.Thechangewillprovideadministrativeandoperationalcontrolsonthefireprotectionprogramthatarecomparabletothoseforotherprogramsimplementedbylicenseconditionandalsoassuresanequivalentlevelofprotection.Basedontheabove,wehavedeterminedthattheproposedamendmentdoesnot(1)involveasignificantincreaseintheprobabilityorconsequencesofanaccidentpreviouslyevaluated,(2)createtheprobabilityofanewordifferentkindofaccidentfromanypreviouslyevaluated,or(3)involveasignificantreductioninamarginofsafety;andthereforedoesnotinvolveasignificanthazardsconsideration.
