, During an NRC inspection conducted from November 2 through 6,1998, one violation of NRC  !

requirements was identified. in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," (Enforcement Policy) NUREG-1600, Revision 1, the .

violation is listed below, l i l

. l Safety Condition S-1 of Special Nuclear Materials License No. SNM-33 authorizes the use of j licensed materials in accordance with the statements, representations, and conditions in Chapters 1 through 8 of the application dated October 29,1993,' and supplements and revisions j

- thereto, l

Chapter 4, Section 4.1.5, " Posting of Limits and Controls," of the supplement, dated August 8, l 1997, requires,- in part, that work and storage areas where special nuclear material (SNM) is l I

handled, processed, or stored shall be posted with the nuclear safety limits and controls applicable to each area. ,

a. Posting Number 104, Revision 3, for the micronizer hoods in the Pellet Plant, requires )

l- that the operator " place white covers over holes in hood when hoppers are not in place.' '

l

b. Posting Number 120 for the filter barriers on the fourth floor of the Oxide Plant requires ,

that the operator " maintain chains at least 6 inches from surface of fumace."

l Contrary to the above,' SNM was not handled or processed in accordance with the posted limits and controls applicable to these areas in the following examples, respectively:

l a. On November 4,1998, operators failed to place a cover (moderation control) over the entire hole of a micronizer hood for Line 2 of the Pellet Pant and failed to place a cover

at all on a micronizer hood for Line 1 of the Pellet Pant when hoppers were not in place l- for these hoods.
b. On November 3,1998, the chain (reflection control) for the secondary filter barrier on l- the fourth floor of the Oxide Plant was not maintained at.least 6 inches from the surface j of the fumace. The chain had been moved so that it was contacting the surface of the l furnace.

l This is a Severity Level IV violation (Supplement VI). (VIO 070-00036/98005-01) l l

The NRC has concluded that information regarding the reasons for the violation, the corrective j t actions taken and planned to correct the violations and prevent reeutrence, and the date when ,

full compliance will be achieved is already adequately addressed in the attached Inspection Report 070-00036/98005(DNMS). However, you are required to submit a written statement or  ;

explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your ,

. corrective actions or your position. In that case, or if you choose to respond, clearly mark your

- response as a

  • Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region lil within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

Notice of Violation if you contest this enforcement action, you should also provide a copy of your response to the Director, Office of Enforcement, U.S. Nuclear Regulatory Commission, Washington, D.C.

20555-0001 if you choose to respond your response will be placed in the NRC Public Document Room (PDR), therefore, to the extent possible, it should not include any personal, privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction. Under the authority of Section 182 of Act 42 U.S.C. 2232, any response shall be submitted under oath or affirmation.
