NOTICE OF VIOLATION ABB Combustion Engineering, Inc. Docket No. 070-00036 j Hematite, Missouri License No. SNM-33 During an NRC inspection conducted from April 6-9,1998, one violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

4 Safety Condition S-1, of Special Nuclear Materials License No. SNM-33, requires that licensed material be used in accordance with the statements, representations, and conditions in Chapters 1 through 8, of the application, dated October 29,1993, with supplements.

Section 2.6, of Chapter 2, of the supplement, dated August 8,1997, requires, in part, that all )

operations which affect licensed material shall be conducted in accordance with approved procedures.  ;

Section 5.2, of Nuclear Industrial Safety Procedure (NIS) No. 221, " Material Handling Equipment," approved March 15,1996, requires, in part, that licensed material hsadling equipment shall be marked with a rated lifting capacity befora it may be used.

Contrary to the above, on April 8,1998, crane cicaves pins used to lift four full UX-30 uranium hexafluoride cylinder overpacks were not marked with a rated lifting capacity before use.

Pursuant to the provisions of 10 CFR Part 2.201,~ABB Combustion Engineering, Inc., is hereby required to submit a written statement or explanation to the U. S. Nuclear Regulatory ,

Commission, ATTN: Document Control Desk, Washington, D.C. 20555, with a copy to the j Regional Administrator, Region Ill,801 Warrenville Road, Lisle,'lllinois 60532-4351, within i 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective

. steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your Notice of

' Violation response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an Order or Demand for Information may be L issued as to why the license should not be modified, suspended, or revoked, or why such other l' , action as mey be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
