n NOTICE OF VIOLATION Combustion Engineering, Inc.

License NJ.

SNM-33 Hematite Facility Docket No. 070-00036 Hematite, Missouri I

l During an NRC inspection conducted on September 20-24, 1993, three violations of NRC requirements were identified.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1993), the violations are listed below:

1.

License No. SNM-33, Condition No. 9 states:

"The license is authorized for use in accordance with statements and conditions contained in the licensee's renewal application dated February 26, 1982, and supplement dated February 23, 1983. Section 2.7 Operating Procedures, states that operating procedures provide detailed instructions for equipment operation and material handling, including specific safety requirements, and that all pertinent regulations and control procedures relative to nuclear criticality safety or radiological safety.are followed."

Operating Sheet No. 601.10, " Sampling Procedure for R-1 Reactor" dated l

August 22, 1991, and revised August 31, 1993, states:

"Open the top valve of the sample line and let the accumulated material (uranyl fluoride) drain into the line between two valves. Close the top valve.

Open the bottom valve and drain the material into the sample can #1.

i Close the bottom valve."

Contrary to the above, on August 25, 1993, radioactive material in the l

form of uranyl fluoride entrained in gaseous hydrogen fluoride passed

through a failed top valve of a two valve sampling line and discharged t

into the work area by passing through the bottom valve that was inadvertently left open by the operator.

Failure to close the bottom valve caused the radioactive plume to discharge into the work area, exposing two workers.

This is a Severity Level IV violation (Supplement VI).

Special Nuclear Material License No. SNM-33, License Condition No. 28.

i states:

"No combustibles shall be stored on the concrete pad."

Contrary to the above, on September 21, 1993, the inspector identified combustible items stored on the cylinder pad, the remains of three cardboard boxes.

This is a Severity Level IV violation (Supplement VI).

Operating Sheet No. 324, " Airborne Release," Section B. " Collecting and l

Counting Smears," states in part:

"Following a release, the employee shall be directed to meet the health physics technician in the clear 1

1 area for a nasal smear prior to cleaning the nose or showering."

Contrary to the above, on July 2,1993, following a release of uranium oxide, the licensee failed to assure that the exposed worker had a nasal smear taken prior to the operator taking a shower.

This is a Severity Level IV violation (Supplement IV).

Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, Region III, 799 Roosevelt Road, Glen Ellyn, Illinois, 60137, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and j

should include for each violation:

(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps j

that have been taken and the results achieved, (3) the corrective steps that i

will be taken to avoid further violations; and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause'why the i

license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
