Thepurposeofthisletteristoclarifyanymisunderstandingofth'eU.S.NuclearRegulatoryCommission(NRC's)regulationsthatrelatetoTitle10oftheCodeofFederalRegulafions(10CFR),Subsection50.71(e)(4).Subsection50.71(e)(4)specifiestheschedularrequirementswherebylicenseesaretosubmitrevisionstotheirFinalSafetyAnalysisReports(FSARs).Itrequiresrevisionstobemade,"...annuallyor6monthsaftereachrefuelingoutageprovidedtheintervalbetweensuccessiveupdatesdoesnotexceed24months."Ina1997surveyoflicensees,wefoundnumerouscasesofnoncompliancewiththisschedularrequirement,inbothsingle-andmulti-unitsites.Acommonexampleofthisnoncompliancewasamulti-unitsitethatbasedtheirsubmissionscheduleforallunitsonthescheduleofoneoftheunits.WeunderstandthatanNRClettertoCommonwealthEdisonCompany(ComEd),datedJune15,1993,mayhavecausedsomeconfusionabouttheproperinterpretationoftheregulation.TheletterendorsedanalternativesubmissionscheduleproposedbyComEd.NeitherComEd'sproposedschedule,northestaff'sendorsement,wereincompliancewiththeregulation.Nevertheless,manylicenseesadoptedthestaffpositionexpressedintheJune15~letteranddeviatedfromtheschedularrequirementsoftheregulation.Inordertocorrecttheerror,thestaffrecentlygrantedexemptionstotheComEdplants.Thetransmittallettertotheexemption(D.SkaytoO.D.Kingsley,datedJuly27,1999),states,"this[Skay]letterandtheenclosedexemptionssupersedeourletterofJune15,1993."WenotethatyouhavenotrequestedaschedularexemptiontoSubsection50.71(e)(4)forSt.Lucieplant.Thisindicatesthatyouintendtocomplywiththeliteralinterpretationoftheregulation,regardlessofhowyouhaveinterpretedtheregulationinthepast.Wewillexerciseenforcementdiscretion,inaccordancewithSectionVII.B.6oftheNRCEnforcementPolicy,forpastviolation(s)ofSubsection50.71(e)(4).Inthefuture,wewillenforcetheschedularrequirementsasprescribed,orasmodifiedbyanexemption.
