TING AND THE ENVIRONMENT Empire State Plaza, Albany, NY 12223 (518) 474-7080 FOR RELEASE: IMMEDIATE NYSE&G/LILCO--NEW HAVEN /STUYVESANT NUCLEAR FACILITY--BOARD TO MEET Albany, Septentar 26 -- The State Board on Electric Generation Siting and The Environment for Case 80008 will meet next month in Albany to discuss further a moticn to dismiss the application and various comments made by parties in the case. The Siting Board meeting--open to public attendance--will begin at 10 AM, Friday, October 12, in the Public Service Commission headquarters in Agency Building 3 of the Gov. Nelson A. Rockefeller Empire State Plaza, Albany. The Board met yesterday to discuss the motion. In Case 80008, New York State Electric and Gas Corporation (NYSE&G) and Long Island Lighting Company filed an application last fall for a State permit to build two 1250 megawatt nuclear generating units at a site in the Town of New Haven, Oswego County, or an alternative site in the Town of Stuyvesant, Columbia County, with a coal-powered alternative at either site. Ecology Action of Oswego filed a motion March 27 to dis iss the filing on the ground that ownership of the proposed plant sas so doubtful that the filing no longer was valid. On an appeal from a Presiding Examiner's ruling denying the motion, the Public Service Commission referred the motion to the Siting Board June 26 and added its recommendation that the filing be dismissed. The Commission held that the

   " motion is not a need motion, it is an ownership motion. .Because the ownership question is fundamental to so many of the public need, siting, and cost issues, . . .a finding that the ownership of the plant is uncertain... requires dismissal."

Charles A. Zielinski, chairman of the Public Service Commission, is chairmar of the Siting Board for Case 80008; other members are James L. Larocca, State Energy Commissioner; M. Peter Lanahan, for the Commissioner of Environmental Conservation; Dr. William E. Seymour, for the Commissioner of Commerce; and Fred Bartle of Oswego, the ad hoc member appointed by the Governor. n/269 7 lJh q)4
