APPROVAL OF RULEMAKING PLAN: MISCELLANE0US CHANGES TG 10 CFR PART 72 AND AMENDMENT TO 10 CFR 40 TO REMOVE NATURAL OR DEPLETED URANIUM USED IN STORAGE CASK SHIELDING FROM PART 40 LICENSING REQUIREMENTS In response to your memorandum. dated February 10. 1997, the Office of Nuclear Material Safety and Safeguards concurs in the Commission paper with the following changes:

e Item 4 in the plan:

change draft rule language to read. "For dry storage, periodic monitoring is sufficient provided that periodic monitoring is consistent with the cask design requirements. The i

monitoring period shall be based upon the cask design requirements."

e Item 8 in the plan: under Regulatory Issue, change "will" to "may" so that it reads ".. anticipated that designers may want to use this material.."
