and to shed light on direct final possibility:

1. Prairie Island uses Boral (borated aluminum) in the basket of their TN-40 cask as a neutron absorber. They were issued an exemption to Part 72 .124-(b) which requires monitoring to assure continued efficacy. The SER written by the staff to support tha exemption permitted this with the justification that "there is no credible way to lose the boral in the basket in this casks therefere, there is no need to verify the continued efficacy of the neutron absorbing material, as required by 10 CFR 72.124(b)." There were no compensating measure required (such as increased concentration od boron). I am trying to get some addional info --- i.e. do we need compensating measures as we discussed.

2. Ft St Vrain stores and periodically uses depleted U shield plugs in their ISFSI. They do not have an exemption to Part 40. They are permitted to store /use depleted U per their license which explicitly states that they are permitted 3 depleted U shielding components of transfer casks. The legal basis for allowing this is that the depleted U was considered "other radioactive material related to the receipt, storage, and transfer of fuel elements" and thus allowed by Part 72 in the Part 72 definition of ISFSI.
