This was an administrative error on the part of the NRC staff. The correction to insert Additional Condition page B-4 does not change the conclusions in the NRC safety evaluation for Amendment Nos. 330 and 309 or the No Significant Hazards Consideration as published in the Federal Register. TRAVELER TSTF-505, REVISION 2, PROVIDE RISK-INFORMED EXTENDED COMPLETION TIMES - RITSTF [RISK-INFORMED TSTF] INITIATIVE 4B, (EPID L-2023-LLA-0021)

On March 26, 2024 (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML24031A540), the Nuclear R egulatory Commission (NRC, the Commission) issued Amendment No. 330 to Renewed Facility Operating License (RFOL) NPF-9 and Amendment No. 309 to RFOL NPF-17 for the McGuire Nuclear Station, Units 1 and 2 (McGuire), respectively. These license amendment requests (LAR) consisted of changes to the technical specifications (TS) in response to your application dated February 16, 2023, as supplemented by letter dated November 2, 2023. The amendments permit the use of Risk-Informed Completion Times (RICTs) for actions to be taken when limiting conditions for operation (LCOs) are not met and adopt Technical Specifications Task Force (TSTF) Traveler TSTF-505, Revision 2, Provide Risk-Informed Extended Completion Times - RITSTF [Risk-Informed TSTF] Initiative 4b.
Following issuance of the amendments, the NRC identified that Additional Condition, page B-4 of Appendix B was omitted inadvertently from the change package for NPF-9 and NPF-17, respectively. This was an administrative error on the part of the NRC staff. The correction to insert Additional Condition page B-4 does not change the conclusions in the NRC safety evaluation for Amendment Nos. 330 and 309 or the No Significant Hazards Consideration as published in the Federal Register. Therefore, consistent with NRC staff guidance dated January 16, 1997 (ML103260096), based on the NRCs policy established by SECY-96-238, this error can be corrected by a letter to the licensee from the NRC staff.
Enclosed please find the corrected McGuire, Units 1 and 2, Additional Condition pages B-4 for Amendment No. 330 for RFOL NPF-9 and Amendment No. 309 for RFOL NPF-17, respectively.
This correction completes the record for Amendment Nos. 330 and 309. The NRC notes, however, that Additional Condition page B-4 was updated subsequently in Amendment E. Pigott - 2 -
Nos. 331 to RFOL NPF-9 and Amendment No. 310 to RFOL NPF-17 to allow implementation of the provisions of Title 10 of the Code of Federal Regulations Section 50.69, Risk-informed categorization and treatment of structures, systems and components for nuclear power reactors, and added a revised license condition page B-4 to Appendix B, Additional Conditions, of the Renewed Facility Operating Licenses for McGuire Nuclear Station, Units 1 and 2, respectively.
Based on the above, the license condition page B-4 was corrected in Amendment Nos 331 and 310. Therefore, no action should be needed by Duke Energy to correct its controlled versions of Appendix B, Additional Condition page B-4. The NRC provides the correction to clarify the record and reconcile the omission.
