10 CFR 31.5(c)(8) requims, in pan, that the licensee transfer or dispose of the device containing byproduct material to persons holding a specific license pursuant to pans 30 and 32 of this chapter or from an Agreement State.
Contrary to the above, on May 18, 1993, the licensee did not transfer or dispose of byproduct material to a person holding a specific license pursuant to pans 30 and 32 of this chapter or from an Agreement State. Specifically, a sealed sourec which was pan of a device was disposed of to a landfill by an outside contractor who did not have a specific license to possess the byproduct' material.
This is a Severity level IV violation (Supplement IV).
Pursuant to the provisions of 10 CFR 2.201, Vishay is hereby required to submit to this office within thiny days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) conective steps which will be taken to avoid funher violations; and (3) the date
        , when fall compliance will be achieved. Where good cause is shown, consideration will be given to extend this response time.
