In response to your original application dated October 4, 2004, the Nuclear Regulatory  
In response to your original application dated October 4, 2004, the Nuclear Regulatory Commission (NRC) issued Amendment No. 275 to Facility Operating License No. DPR-66 and Amendment No. 156 to Facility Operating License No. NPF-73 for the Beaver Valley Power Station, Unit Nos. 1 and 2 (BVPS-1 and 2) on July 19, 2006. Subsequently, by letter dated November 30, 2006, as supplemented by letter dated March 28, 2007, you submitted certain corrected information regarding the steam generator tube rupture analysis, impacted by the extended power uprate. Your correction letters indicated that you have performed a Title 10 of the Code of Federal Regulations (CFR) 50.59 evaluation to address the analytical changes and the Emergency Operating Procedure updates and determined that prior NRC approval was not required to implement the changes.
 
Pursuant to 10 CFR 50.59, licensees are permitted to make changes to the facility and procedures, as described in the updated final safety analysis report (UFSAR), and to conduct tests or experiments not described in the UFSAR, without prior NRC approval, provided a change to the Technical Specifications is not involved or the proposed change, test or experiment does not meet the criteria of 10 CFR 50.59(c)(2).
