The purpose of this letter is to inform you of our decision to cease implementation of NRC Inspection Manual Chapter (IMC) 0305, "Operating Reactor Assessment Program," dated June 13, 2012, and IMC 2515, "Light Water Reactor Inspection Program - Operations Phase," for the Kewaunee Power Station as of May 31, 2013.
On February 25, 2013, you notified the NRC of your intent to permanently shut down and decommission the Kewaunee Power Station. On May 14, 2013, you notified us that the Kewaunee Power Station was permanently shut down and that all nuclear fuel was removed from the reactor vessel. Therefore, the Kewaunee Power Station will no longer be assessed under IMC 0305, "Operating Reactor Assessment Program," and IMC 2515, "Light-Water Reactor inspection Program - Operations P hase."  Beginning June 1, 2013, the NRC's oversight of your licensed activities will be conducted under the provisions in IMC 2561, "Decommissioning Power Reactor Inspection Program," dated April 14, 2003. The objectives of IMC 2561 are to verify that decommissioning activities are being conducted safely, that spent fuel is safely stored onsite or transferred to another licensed location, and that site operations and licensee termination activities are in conformance with applicable regulatory requirements, licensee commitments, and management controls.
With the transition to IMC 2561, it is no longer necessary for you to report Reactor Oversight Process performance indicator data associated with the Kewaunee Power Station, as described in IMC 0608, "Performance Indicator Program."  Although the inspection program for NRC oversight at your facility will change, all license commitments remain in effect until altered by formal action from the NRC.


By letters dated April 4 and 30, 2013, the NRC notified you of two inspection findings involving the Emergency Preparedness and Mitigating Systems Cornerstones, each having low to moderate safety significance (White). In the letters, we stated that we would conduct supplemental inspections to review the actions taken to address the performance issues using Inspection Procedure (IP) 95001, "Inspection for One or Two White Inputs in a Strategic Performance Area."  Since IMC 0305 and IMC 2515 are no longer applicable to Kewaunee Power Station, we will conduct these inspections using IP 92702, "Follow-Up on Corrective Actions for Violations and Deviations," dated January 10, 2008, to verify appropriate corrective actions are being implemented.

Chapter 2561, "Decommissioning Power Reactor Inspection Program," the NRC Region III staff developed a Master Inspection Plan (MIP) for the Kewaunee Power Station for the remainder of calendar year 2013. The inspection plan is based on your current performance in executing the site decommissioning project and the schedule of activities planned for the period June through December 2013.

The following is a list of the routine and discretionary inspection procedures (IPs) we expect to use during our inspections. The procedures used during each inspection will depend on the specific activities being conducted at the site. Additional discretionary inspection procedures may be used if decommissioning activities warrant.
The ROP baseline emergency preparedness inspection procedure IP 71114 (including attachments with the exception of IP 71114.06) will be completed for 2013 and 2014, to assure the licensee maintains the required emergency preparedness program. The schedule and scope of the emergency preparedness inspection activities will be adjusted based on the licensees schedule of decommissioning activities and current licensing basis. Inspection procedures 82301, 82302, and 82701 may be used as additional guidance for these inspections during this period.

Heacock By letters dated April 4 and 30, 2013, the NRC notified you of two inspection findings involving the Emergency Preparedness and Mitigating Systems Cornerstones, each having low to moderate safety significance (White). In the letters, we stated that we would conduct supplemental inspections to review the actions taken to address the performance issues using Inspection Procedure (IP) 95001, Inspection for One or Two White Inputs in a Strategic Performance Area. Since IMC 0305 and IMC 2515 are no longer applicable to Kewaunee Power Station, we will conduct these inspections using IP 92702, Follow-Up on Corrective Actions for Violations and Deviations, dated January 10, 2008, to verify appropriate corrective actions are being implemented.

The enclosed inspection plan lists the inspection procedures scheduled through December 31, 2013, as part of our IMC 2561 inspection program. The NRC provides the inspection plan to allow for the resolution of any scheduling conflicts and personnel availability issues. The NRC will contact you to discuss the inspection plan should circumstances warrant any changes. This inspection plan does not include security-related inspections. Information regarding security-related inspections will be sent via separate, non-publicly available correspondence.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspection in the component of NRC Public Document Room or from the Publicly Available Records System (PARS) component of NRCs Agencywide Documents Access and Management System (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).

Kewaunee Master Inspection Plan In accordance with the U.S. Nuclear Regulatory Commission (NRC) Inspection Manual Chapter 2561, Decommissioning Power Reactor Inspection Program, the NRC Region III staff developed a Master Inspection Plan (MIP) for the Kewaunee Power Station for the remainder of calendar year 2013. The inspection plan is based on your current performance in executing the site decommissioning project and the schedule of activities planned for the period June through December 2013.

The following is a list of the routine and discretionary inspection procedures (IPs) we expect to use during our inspections. The procedures used during each inspection will depend on the specific activities being conducted at the site. Additional discretionary inspection procedures may be used if decommissioning activities warrant.

The ROP baseline emergency preparedness inspection procedure IP 71114 (including attachments with the exception of IP 71114.06) will be completed for 2013 and 2014, to assure the licensee maintains the required emergency preparedness program. The schedule and scope of the emergency preparedness inspection activities will be adjusted based on the licensees schedule of decommissioning activities and current licensing basis. Inspection procedures 82301, 82302, and 82701 may be used as additional guidance for these inspections during this period.
