~+p In response to part (a)of the above request, please be advised.that the date of commercial operation of the Donald C.Cook Nuclear Plant Unit No.1 was August 23, 1975.Therefore, the date on which our next regular 40 month inspection period begins is December 24, 1978.The regulations require us to perform the inspections for this period and.each succeeding 40 month cycle to the code edition and addenda in effect 6 months prior to the start of the new cycle, to the extent practical within the limitations of design, geometry and materials of construction.

We are concerned with the feasibility of meeting ASME Code requirements issued, shortly (less than one year)before the next 40 month inspection period due to the potentially long lead time necessary to evaluate the new or revised requirements and to develop the program necessary to implement them where practical or to compile the information supporting any determinations that conformance with certain ASME code requirements is impracticable.

Also, a subsequent time period is required to plan, contract for, and obtain new tools for the physical task of conducting an inspection.

This is in response to Mr. Victor Stello, Jr.'s letter of July 16, 1976, which was received on July 19, 1976, requesting that we submit within 20 days of receiving his letter a date when we would submit certain requested information pertaining to fire protection at the Donald, C. Cook Nuclear Plant Unit No. 1 and the new NRC guidelines in Standard Review Plan,-"9.5.1 "Fire Protection". This same. information was requested for the Donald C.

Cook Nuclear Plant Unit No. 2 in Mr. Roger S. Boyd's letter to us of July 30, 1976. This letter was received on August 2, 1976, and gave us 20 days to reply for Unit No. 2.

This response is for both Unit No. 1 and Unit No. 2 of the Donald C. Cook Nuclear Plant. Ne shall file a submittal supplying the requested information for both Unit No. 1 and Unit No. 2 together by January 31, 1977.

This is in response to Mr. Karl Kniel's le of June 29, 1976, which 1ras received. on July 2, 1976, requesting: (a) the date on which our facility's next 40 month ASME Section Xl inservice inspection period commences and; (b) the date of submittal of an amendment request to the Appendix "A" Technical Specification to conform to certain ASME Section Xl inservice inspection and testing requirements.

In response to part (a) of the above request, please be advised. that the date of commercial operation of the Donald C. Cook Nuclear Plant Unit No. 1 was August 23, 1975. Therefore, the date on which our next regular 40 month inspection period begins is December 24, 1978.

The regulations require us to perform the inspections for this period and. each succeeding 40 month cycle to the code edition and addenda in effect 6 months prior to the start of the new cycle, to the extent practical within the limitations of design, geometry and materials of construction.

This edition would. be the winter of 1977 addendum for the period beginning December 24, 1978.

Your letter states that a technical specification amendment request required to meet the inservice inspection and testing requirements of the Code of Federal Regulations must be submitted 6 months prior to the start of the next regular 40 month inspection period. For the 40 month period beginning December 2I+, 1978, this amendment request is due in June, 1978. Although an amendment can be requested that will conform to the suggested. wording in the Enclosure to your July 2, 1976 letter, these words are not meaningful because they do not detail the inspection to be carried. out.

<"We believe the proper approach is to submit to you the inspections that can be performed and request relief for those that cannot be performed.

We are concerned with the feasibility of meeting ASME Code requirements issued, shortly (less than one year) before the next 40 month inspection period due to the potentially long lead time necessary to evaluate the new or revised requirements and to develop the program necessary to implement them where practical or to compile the information supporting any determinations that conformance with certain ASME code requirements is impracticable.

Also, a subsequent time period is required to plan, contract for, and obtain new tools for the physical task of conducting an inspection. Therefore, if the addenda in effect 6 months prior to a new inspection period were extensive we may well not be able to meet their requirements and, we may well have to fall back to an earlier addenda.

Please note that for the first 40 month cycle which commenced at the start of commercial operation, we are performing our ASME Section XI inspection and. testing in accordance with our existing Technical Specification.

Paragraph 2 of your letter is unclear regarding the require-ments for the initial cycle. Since their issuance, we have interpreted. the regulations 10 CFR 50.5$ (a) (g) (4)

(v) to allow inspections during this initial 40 month cycle in accordance with our existing Technical Specifications, and accordingly we have not undertaken the planning and development that would permit us to perform the additional inspection in this period to the new regulations effective September 1, 1976.
