August 15, 2018 ORDER (Clarifying Briefing Schedule Regarding Gomez Petition)
On August 9, 2018, the Office of the Secretary issued a memorandum to the Atomic Safety and Licensing Board Panel (Panel) stating that it had received a petition to intervene and request for hearing from Mr. Albert Gomez via email on August 2, 2018. See Memorandum from Annette L. Vietti-Cook, Office of the Secretary, to E. Roy Hawkens, Chief Administrative Judge, Atomic Safety and Licensing Board Panel (Aug. 9, 2018) [hereinafter SECY Memo]. The memorandum explained that Mr. Gomez had communicated with the Office of the Secretary regarding issues he encountered in submitting his petition through the agencys Electronic Information Exchange. Id. The Office of the Secretary referred Mr. Gomezs petition to the Panel pursuant to 10 C.F.R. § 2.346(i) and, in addition, served the referral on the parties and participants to this proceeding. Id.1 1  The Office of the Secretary referred the entire petition to the Panel, save for section IV(3) in which Mr. Gomez requested an extension to submit formal environmental scoping comments.
SECY Memo at 1. That portion of the petition was referred to the Office of the Executive Director for Operations for appropriate action. Id.


(Turkey Point Units 3 and 4)  
Consistent with 10 C.F.R. § 2.309(i)(1), answers to Mr. Gomezs petition must be filed no later than Tuesday, September 4, 2018. If Mr. Gomez wishes to reply to the answers, any such reply must be filed no later than Tuesday, September 11, 2018. See 10 C.F.R. § 2.309(i)(2).
It is so ORDERED.
