Hello Margaret,

This e-mail is in response to Kairos request, by e-mail below dated August 22, 2024, regarding access to a certain non-public document relating to nuclear reactor security. Upon review of the request, the NRC staff has established that Kairos does have the need-to-know for this document. Therefore, the following document is being made available to Kairos:

• DG-5071, Target Set Identification and Development for Nuclear Power Reactors (Proposed Revision 2 to Regulatory Guide 5.81), dated July 2024

Hello Louis and Stanley,

I am reviewing the Alternative Physical Security for Advanced Reactors proposed rulemaking and draft guidance documents on behalf of Kairos Power. I saw that access to DG 5071, Target Set Identification and Development for Nuclear Power Reactors is need-to-know. As an advanced reactor developer, Kairos Power is a stakeholder for DG-5071 and has a need to access DG-5071 for review and comment.

How can Kairos Power access to DG-5071 to review? How would NRC like to receive comments?

Kairos Power has an active Safeguards Information Protection Program in place and is currently in possession of a construction permit for a non-power reactor.
