SUBJECT:
EMERGENCY ACCESS RlLEMAKING (10 CFR Part 62)
The purpose of this memorandum is to confirm agreements reached at a meeting held on September 13, 1988, between M. Silberberg, R. Grill, and myself.
These agreements relate to the Emergency Access Rulemaking (10 CFR Part 62).
Specifically, we discussed the requirement that directed the staff to work with the Department of Energy (DOE) and the Department of Defense (D0D) to resolve the certification process for making emergency access determinations that are based on the protection of common defense and security.
With regard to this subject, it was agreed that:
(1) The Office of Research (RES) will have the lead in resolving the certification issue; (2) RES will set-up meetings with both DOE and D0D to continue discussions on this matter; (3) NMSS will participate in the meetings.
I will personally attend any meetings if needed.
(4) RES and NMSS will jointly agree on the level of authority that would be acceptable from both DOE and D0D for the certification signature.
