Dear Dr.' Rogers:

This is to request your permission for me to visit your clinic to receive an overview of the science and technology of teletherapy and brachytherapy. This request is based on informal conversations I have had with you and Dr. Wessels of your staff over the past few months.

The purpose of the visit is purely educational. The Commissioners have expressed renewed interest in the Commission's responsibility to assure public health and safety vis-a-vis the medical use of byproduct material. The quality of the Commission's regulations and guidance to licensees will be better if, prior to their development, I can observe current radiation therapy science and technology in practice.

I will spend two full-time weeks at your clinic learning the following:

Set-up Application At all times I will be under the direction of one of your employees; Dr. Wessels will supervise my visit. I will respect your patients' rights to privacy and confidentiality. I will not interfere with the operation of your clinic.

Although the purpose of my visit is to learn radiation therapy, if I happen to -

perceive any safety problems, they will be brought to your attention. Your clinic will not charge the NRC for this practicum.

If this meets with your approval, please have Dr. Wessels call me to schedule the visit.

PROPOSED IMPOSITION OF CIVIL PENALTY - $2,500 AND CONFIRMATORY ORDER This is to inform the Commission that a Confirmatory Order and a Notice of I Violation and Proposed Imposition of Civil Penalty in the amount of Two Thousand Five Hundred Dollars ($2,500) will be issued on or about August 7,1986 to Maryview Hospital. This action is based on a _ failure to administer the proper.

chemical form of a radiopharmaceutical to a patient at Maryview Hospital. This resulted in a significant dose to the bone marrow of the patient.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice August 7, 1986 Telephone Notification of Licensee August 7, 1986 A news release has been prepared and will be issued after Lhe licensee receives the Notice. The State of Virginia will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.

Under terms of the Order, the licensee may within 20 days of the date of the Order request a hearing.
