" RADIATION. THERAPY QUALITY ASSURANCE AND PENALTIES FOR NEGLIGENCE" i My. staff has reviewed the draft Advance Notice of Proposed Rulemaking as requested in a memorandum from R. E.-Cunningham to Regional Administrators dated November 24, 1986.- T. T. Martin and J. E. Glenn of my staff discussed this draft with R. E. Cunningham and N. L. McElroy of your staff by phone on December 9,1986. .We endorse these efforts to prevent misadministration. We support rulemaking to establish quality assurance programs and to enable the staff'to take enforcement actions for failure to implement an effective quality assurance program. We' share the belief of your staff that focusing on negligence'will not necessarily enhance the public's response to the Advance-

. Notice of Proposed Rulemaking. Our specific comments have been discussed by phone. We have no further comments and concur in sending the proposed action to the Commissioners for their approval.
