COMMISSION PAPER: QUALITY ASSURANCE AND PENALTIES FOR NEGLIGENCE In the' conference call of December 18, 1986 on actions that NMSS would be taking on medical misadministration, AE0D noted that'our forthcoming report on I-131 misadministration might identify the need for some changes to the regulations in addition to those described in the subject Commission paper. Enclosure 3 to the Commission paper acknowledges this consideration. During the conference call, however, we did not understand that the package of proposed changes to the Part 35 regulations would be forwarded to the Commission by January 31, 1987. In order to highlight the fact that subsequent changes to the proposed ANPRM or other regulatory action may result from your review of our report, we request that you include in the body of the Comission paper a. statement such as:

                                 "Other Work in Progress The Commission paper describes proposed changes in the regulations for therapy licensees. As we note in Enclosure 3, AE00 is currently studying certain diagnostic misadministration that lead to doses in the near-therapy range. We will review their evaluation when it is published and determine if any additional actions by the NRC are warranted and how these actions may best be accomplished. We will inform the Commission if the actions proposed in this paper are subsequently changed as a result of the ongoing AE00 study."

AE0D routinely announces the publication of engineering evaluations, such as the one on I-131 misadministration, in our weekly highlight report. In addition, David Humenansky of Chairman Zech's staff gets copies of all of our reports. jM20g096871201 35y 52FR36942 PDR
