Dear Mr. Rushforth:
This is in response to your request made pursuant to the Freedom of Information Act and 10 CFR 2.744 of the Commission's Rules of Practice to inspect all documents and records relating to the geology and scismicity in the vicinity of the Diablo Canyon Nuclear Generating Station site. Your request is being processed pursuant to the Commission's regulations implementing the Freedom of Information Act, Subpart A of 10 CFR Part 9.
In searching'f.or the documents applicabic to your request, we have sought to locate all documents pertaining to the geology or scismicity of the Diablo Canyon site which were used or considered by the Licensing staff and ACRS in their review of the Diablo Canyon application. The search indicated that the majority of this material is presently available in the NRC Public Document Room (PDR),1717 H Street, N. W., Washington, D. C.
and in the local PDR at the San Luis Obispo County Library, 888 Morrow Street, San Luis Obispo, California.
Additic,nal copics of tha material already available have not been reproduced.
In Appendix A are listed 134 documents which have.not been previously released.
Although nany of these docuuents arc exempt from production or disclosure under the Freedom of Information Act, tbc NRC has found that their production or diaclosure is not contrary to the public interest, and copies of the documents are heing placed in the NRC Public Document Room and the local POR in San Luis Obispo.
In additico, there arc approximately 1250 feet of scismic charts which are available for your inspection at the i
Commission's Offices in Bethesda, Maryland.
Because of the excessive costs to reproduce copics of these charts, copies are not being placed in the j
NRC or local public document rooms.

With respect w the ACRS documents, the documents listed in Appendix 3 are already available in the NRC Public Document Room.

Deletions in the minutes and the consultant reports have been m.Mc in accordance with the August 27, 1974 press release concerning ACRS material to be made 1
public. A copy of this press release is enclosed as Appendix D.
l The documents listed in Appendix E are ACRS material which is being placed i
in the NRC and local public document rooms with only the individual names 1
deleted. The deletions have been made on the basis that the documents were prepared for-the internal use of the ACRS, and contain the advice, opinion, and recommendations of ACRS consultants and staff members.
Pursuant to 10 CFR 9.15 of the commission's regulations, it has been determined that the ACRS information being withheld is exempt from production of disclosure and that its prcduction or disclosure is contrary to the public interest.
This denial is based upon exemptio'n (5) of the Freedom of Information Act '(5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.
The persons responsible for this denial are Mr. John C. Iloyle, the NRC Advisory Committee Management Officer, and Dr. Dade W. Moeller, Chairman, ACRS, acting for the Committee.
As provided in 5 9.15, this denial may be appealed to the Commission within 30 days of the receipt of this letter. Any such appeal shal.1 be in writing, addressed to the Secretary of the Commission, U. S. Nuclear Regulatory Commission, Washington, D. C.
20555, and should cicatly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."
