This letter is in response to your letter of April 29, 1977 which indicated that you would like to have one of your technical consultants either participate in, or observe the Staff's audit of the Diablo Canyon seismi design. For the following reasons, your technical consultants may ob5erve, but not participate in, seismic audits.

The Staff's audit activities in this case are similar in nature to the regulatory functions related to inspections, investigations and other independent activities which fall within the area of legally permitted ex parte corriunication. Accordingly, we censider participation or obser-vation by any other person or party tc be a matter within the discretion i of the parties concerned. Due to the unusual circumstances of this case, we are willing to have one or two of your technical consultants attend the upcoming audit meetings and plant tours associated with the Diablo ,

Canyon audit as long as they do not impede the progress of the audit. )

Because of time and resource limitations of the Staff, your technical advisors should be prepared to attend as observers rather than partici-pants.

Subsequent to the seismic audit, we will be willing to discuss our audit findings and conclusions with you and/or your consultants.

OF MEETING HELD ON FEBRUARY 4, 1977 TO DISCUSS THE DIABLO CANYON SEISMIC DESIGN REEVALUATION 1

We met with the applicant and its consultants on February 4, 1977 to {

discuss the Diablo Canyon Seismic design reevaluation. A list of attendees is provided in Enclosure No.1.

PG&E was conducting a reevaluation of the seismic, capabilities of Diablo Canyon as had been requested by the NRC staff in Supplements 4 and 5 to the Safety Evaluation Report. The purpose of the meeting l was to discuss a number of the methods and criteria that PG&E was l proposing to use in the reevaluation.

PG&E presented a specification that described the methods and criteria proposed for use in reevaluating the major structures. These proposals were discussed and various changes were made to the specification during the meeting. At the conclusion of the meeting we indicated to PG&E that the proposed methods and criteria, as changed during the meeting, would be acceptable to the NRC staff. Enclosure 2 reflects the staff's understanding of the methods an# criteria that were agreed upon.

The specification discussed above dealt only with the major structures.

PG&E indicated that additional specifications, describing the criteria to be used for equipment, tanks, piping, etc. would be provided in the near future.

In addition, PGSE was working on responses to comments and questions from consultants to the Advisory Coninittee on Reactor Safeguards.
