SUBJECT: RESPONSE TO NRC INSPECTION REPORT 05000498/2020090;

05000499/2020090, APPARENT VIOLATION

Dear Mr. Powell:

On July 6, 2020, the U.S. Nuclear Regulatory Commission (NRC) issued an apparent violation

to STP Nuclear Operating Company for the failure to maintain a quality record complete and

accurate in all material respects.

The NRC Inspection Report 05000498/2020090; 05000499/2020090 (NRC Agencywide

Documents Access and Management System (ADAMS) Accession No. ML20188A214)

informed you that before the NRC makes its enforcement decision, we are providing you an

opportunity to (1) respond in writing to the apparent violation addressed in this inspection report

within 30 days of the date of this letter, (2) request a predecisional enforcement conference

(PEC), or (3) request alternative dispute resolution (ADR). In a letter, dated August 5, 2020,

you provided your response to the apparent violation (ADAMS Accession No. ML20218A448).

We have reviewed the information provided in your response with respect to your completed

and proposed actions.

On August 6, 2020, the NRC held a closed PEC with a former contract employee of STP

Nuclear Operating Company (ADAMS Accession No. ML20209A612). During this conference,

new information was presented to the NRC that is germane to our determination of the

significance of the apparent violation in Inspection Report 05000498/2020090;

05000499/2020090.

The NRC will evaluate this new information and inform you in separate correspondence of our

final determination of the significance of the apparent violation.

In accordance with Title 10 of the Code of Federal Regulations 2.390 of the NRCs Agency

Rules of Practice and Procedures, a copy of this letter will be made available electronically for

public inspection in the NRC Public Document Room or from the NRCs ADAMS, accessible

from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
