SOUTH TEXAS PROJECT, UNITS 1 AND 2 AND THE ASSOCIATED INDEPENDENT SPENT FUEL STORAGE INSTALLATION - ORDER APPROVING INDIRECT TRANSFER OF LICENSES AND CONFORMING LICENSE AMENDMENTS (EPID L-2023-LLM-0004)
Dear Mr. Powell:
The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the application dated June 12, 2023 (Agencywide Documents Access and Management System Accession No. ML23163A176), as supplemented by letters dated August 31, 2023, and October 5, 2023 (ML23243B056 and ML23279A138, respectively), filed by STP Nuclear Operating Company, acting on behalf of Constellation Energy Generation, LLC (CEG) and NRG South Texas LP (NRG South Texas) and its parent companies, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) sections 50.80, Transfer of licenses, and 72.50, Transfer of license, requesting approval of the indirect transfer of Renewed Facility Operating License Nos.
NPF-76 and NPF-80 for South Texas Project (STP), Units 1 and 2, respectively, and the general license for the STP Independent Spent Fuel Storage Installation (collectively, the Facility) from NRG South Texas to CEG. NRG South Texas owns a 44 percent share of the Facility and holds possession-only rights in the NRC licenses.
is the order that consents to the license transfer, subject to the condition described therein. The order also approves, pursuant to 10 CFR 50.90, Application for amendment of license, construction permit, or early site permit, the draft conforming license amendments in. These amendments will be issued and made effective at the time of the completion of the license transfer. Enclosure 3 is the proprietary version of the NRC staffs safety evaluation related to the application. Enclosure 4 is the non-proprietary version of the NRC staffs safety evaluation.
The order will be forwarded to the Office of the Federal Register for publication.
