AFFIDAVIT OF DR. RICHARD B. FERGUSON REGARDING NOTIFICATION OF GENERIC ISSUE 82 I l

DR. RICHARD B. FERGUSON. being duly sworn. deposes and says '

as follows:

1. Some time in April, 1987. I received copy of the BOARD NOTIFICATION REGARDING BNL DRAFT REPORT ON SPENT FUEL POOL ACCIDENTS (BN 87-05), dated March 27, 1987. The exact date of the receipt was not recorded. The local public document room recorded the receipt of this document on April 22, 1987.

2. The Board Notification refers to a draft report issued by Brookhaven National Laboratory entitled "Beyond Design-Basis Accidents in Spent Fuel Pools (Generic Issue 82)". I did not receive a copy of this report with the Board Notification, nor have I received a copy of this report from PG6E or from the NRC at any time since receiving the Board Notification.

3. I first received a copy of the Brookhaven report on June 9, 1987, from Ms. Nancy Culver of the San Luis Obispo Mothers for Peace. I

4. The Board Notification claims that "The draft report does not pertain directly to currently ongoing licensing efforts for spent fuel pool expansion annodment requests by utilities. l including hearings." Not having o ( :py of the report at the time,  ;

5. I have now briefly reviewed the report. It is my opinion that the Board Notification le fnise and misleading and that the potential for fuel claddine firem analyzed in the report pertains precisely to high density rerackings such as that proposed for Diablo Canyon Nuclear Power Plant.

6. Two of the authors of the report recommend in the draft report that high density racks such as those propoied for Diablo Canyon not be used until the fuel has aged for several years.

7. The report also recommends that a site-specific analysis be performed for each spent fuel pool in order to ascertain more accurately the risk of cladding fires.

8. It is my professional opinion that these two recommendations are reasonable and prudent given the current state of knowledge regarding fuel cladding fires. I support these recommendations.
