l AFFIDAVIT OF WALTER L. BROOKS REGARDING THE INTERVENORS' APPLICATION FOR STAY I, Walter L. Brooks, being duly sworn, state as follows:
1.
I am employed by the U. S. Nuclear Regulatory Commission as a Nuclear Engineer in the Reactor Systems Branch, Division of PWR Licensing-A, Office of Nuclear Reactor Regulation. A copy of my professional oualifications is attached.
2.
I have reviewed the Application for Stay by San Luis Obispo Mothers for Peace and Sierra Club, Santa Lucia Chapter, dated June 16, 1986 and the attached affidavit by Dr. Richard B. Ferguson, dated June 16, 1986.
I have participated in the preparation of the NRC Safety Evaluation Report, dated May 30, 1986, supporting the issuance of License Amendments No. 8 and No. 6 for Diablo Canyon Units 1 and 2, respectively, regarding the expansion of the spent fuel pools.

I will address the criticality aspects of the concern expressed by Dr. Ferguson regarding the decreased separation between neighboring fuel assemblies and potential collisions between the new racks.
See Ferguson Affidavit, Paragraph 11.

The criticality consequences of collisions between racks during a seismic event was addressed in the staff's March 30, 1986 Safety Evaluation Report (page 5) in which it was stated that design features were present which prevented reduction of rack-to-rack spacing to a point at which the effective multiplication factor would exceed 0.95 even in the absence of baron in the pool water.
Given the presence of boron, the effective multiplication factor would be less than 0.8.
The means by which the racks are kept apart are described in the licensee's submittal of September 19, 1985 (see page 4-25).
Accordingly, the staff has considered and reviewed the new racks and separation of fuel assemblies with regard to criticality, including the potential for rack collision, and concluded that the new racks meet the NRC criterion for criticality.

My name is Walter L. Brooks.
I am employed as a Nuclear Engineer in the Reactor Systems Branch, Division of PWR Licensing-A, Office of Nuclear Reactor Regulation (NRR).
In my position I have primary review responsibility for the core physics aspects of applications for construction permits and operating licenses.
In addition I review the criticality aspects of fuel storage racks at the request of the branch having primary review responsibility.
In the area of operating reactor licensing actions I have primary responsibility for the review of core physics and spent fuel pool criticality aspects.
I have held this position for six months.
I held a similar position for six years in the previous NRR organization.
I hold a bachelors degree in mathematics from Lincoln Memorial University and masters degree and doctorate from New York University.
Prior to joining NRC (then the Atomic Energy Commission) in 1974 I had a total of 21 years of experience beyond graduate school - almost entirely in the nuclear field. All of my employment was with the Gulf United Corporation, Nuclear Development Corporation of America, and Nuclear Development Associates. Among my duties during my employment from 1953 to 1974 were performance and evaluation of critical experiments for light water moderated, heavy water moderated, and fast (liquid metal moderated) reactors, development of calculation methods for heavy water moderated reactors and verifiction and modification of a nodal calculation technique for light water moderated reactors,
