ACTION: Entergy Request for a One-Time Exercise Exemption (ANO)

The attached letter from Entergy dated July 13, 2020, is requesting a one-time schedular exemption for Arkansas Nuclear One, Units 1 and 2 (ANO-1 and ANO-2) from the requirements of 10 CFR 50, Appendix E, Sections IV.F.2.b and IV.F.2.c. Entergy is requesting to postpone the full-participation biennial emergency preparedness exercise, originally scheduled for September 15 and 16, 2020, until a proposed date in March 2021, due to the on-going COVID-19 Public Health Emergency. A March 2021, date for the rescheduled exercise falls within 35 months from the month of the previously evaluated exercise conducted July 17, 2018. If this exemption request is granted to allow Entergy to conduct the CY 2020 biennial exercise in CY 2021, Entergy indicates that future biennial EP exercises will continue to be held as planned in even years.

In the enclosure to its July 13, 2021 letter, Energy stated they had conducted a teleconference with the Federal Emergency Management Agency (FEMA) and Arkansas Department of Health (ADH) on June 10, 2020. This call was used to discuss the need to seek an exemption and the activities planned for the successful completion of the ingestion pathway exercise regardless of it being completed in 2020 or 2021. Entergy further stated that the ADH is aligned with, and has requested that, Entergy strongly consider requesting a deferral of the ingestion pathway exercise to 2021, based on the needed response to the

pandemic and the uncertainty of the future in this matter.

As part of the NRCs evaluation of the proposed one-time exemption to the biennial exercise scheduling requirements of 10 CFR 50, Appendix E, Sections IV.F.2.b and IV.F.2.c, I am requesting that FEMA Technological Hazards Division document their acceptance of this proposed March 2021, exercise date in an email or letter back to the NRC. This email or letter will be entered in the NRCs Agencywide Documents Access and Management System (ADAMS) and cited in our technical evaluation documenting FEMAs acceptance of this proposed one-time exemption and proposed DCPP exercise date.

NOTE: The attached letter has not yet been entered and declared publicly available in ADAMS. As such, please control forwarding of this letter to required FEMA staff.
