SUBJECT:

REVIEW OF FINAL RULE, " REQUIREMENTS FOR CRIMINAL HISTORY CHECKS" This memorandum transmits the subject final rulemaking for Comittee to Review Generic Requirements (CRGR) review. The CRGR was briefed on the proposed rule on September 17, 1986, CRGR Meeting No. 96.

The final rule requires implementation of procedures for the control and use

. of criminal history data received by the licensee from the Federal Bureau of Investigation (FBI). This action is required under Public Law 99-399, "The Omnibus Diplomatic Security and Anti-Terrorism Act of 1986," which mandates FBI criminal history checks of individuals with unescorted access to nuclear power plants. Licensees cannot have access to the FBI criminal history data provided for by the Act until NRC has established regulations for the control and use of the data. The Act also stipulates that the NRC shall promulgate these regulations no later than six months after the date of the enactment of this Act, which is February 27, 1987.

The Offices of Administration, Inspection and Enforcement, Nuclear Reactor Regulation, Resource Management, Information Resource Management, and Public Affairs have concurred in this rulemaking. The Office of the General Counsel has no legal objection.

Dear Sir / Madam:

As indicated in the Supplementary Information Statement of proposed rule 10 CFR Part 73.57, " Requirements for Criminal History Checks," this is to advise that -

an initial supply of fingerprint cards (FD-258) are now available and may be obtained by contacting Ms. Vivian Miller or Ms. Beverly Martin, Records Management Branch, U.S. Nuclear Regulatory Comission (NRC), on (301) 492-8293

~ or 492-8138, respectively. The FBI fingerprint cards which will be used for criminal history checks have been assigned FBI organizational indicator (ORI)

"MDNRC000Z." To ensure receipt of the proper cards, it is very important that you specifically request "FD-258, ORI, MDNRC000Z" whenever ordering and that this ORI number appears on the cards you receive (see Enclosure 1). FD-258s that do not have the correct ORI number should not be used. If your organi-zation has already requested a supply of fingerprint cards, all or an initial portion of what you requested will be provided as the current stock permits.

The Office of Management and Budget (OMB) has approved the use of the FD-258 to collect the personal information requested under the proposed rule, 10 CFR Part 73.57. The OMB approval number is 3150-0002 with an expiration date of .

November 30, 1989. This information, however, has not been annotated on the preprinted stock of FD-258 fingerprint cards. Therefore, anyone inquiring about the need for OMB approval to collect the information should be informed of the above approval number and expiration date.

If your organization has not yet done so, we ask that you identify to me as soon as possible the name, address, and telephone number of the point (s) of contact at your facility (ies) authorized to submit fingerprints to the NRC and receive the results under the Criminal History Program. This will greatly aid us in compiling appropriate mailing lists and facilitating the processing of fingerprint cards.

If you find it advantageous to begin to submit fingerprint cards to NRC prior to the effective date of 10 CFR Part 73.57, we will start accepting them on February 23, 1987. However, processing of the cards will not begin until 10 CFR Part 73.57 becomes effective. Your completed fingerprint cards should be submitted in accordance with the rule to the Director, Division of Security, U.S. Nuclear Regulatory Comission, Washington, DC 20555, Attention: Criminal History Check Section. Enclosure 2 is a sample letter that should be used to transmit your cards and associated check to NRC. Should a receipt for the check and/or fingerprint cards be desired, it is suggested that certified mail, return receipt requested, be used.

JAN 2 81987 If you have any questions on the proposed fingerprint processing procedures, please contact Ms. Beth Bradshaw on (301) 492-4120. Since we expect a significant initial volume of cards for processing, we ask that during the initial 6 month period of the rule you refrain from making telephonic status checks for at least 90 days after the forms are submitted to NRC.

Please note that any changes deemed necessary to the procedures outlined above will be reflected in the final rule requirements which will take precedence.
