SUBJECT:

REVIEW 0F PROPOSED RULE ON CRIMINAL HISTORY CHECKS - 10 CFR 73.57 We have reviewed the draft proposed rule package forwarded with your memorandum of July 29, 1986, and concur with the paper. Comments were discussed with your staff on August 5,1986. The key recommendations were:

Include impact on IE resources to develop inspection program, on Regions to inspect, and on Division of Security for processing the data Interfaces with the access authorization program should be described, especially as related to processing of foreign materials, interim status of those appealing the accuracy of FBI records, and impact on NRC and industry.

The inspectability and enforceability of the exercise of appeal rights would be enhanced by requiring evidence that the person was afforded that opportunity.

" Malicious or capricious manner" in 73.57(b)(5) is not inspectable or enforceable, nor is " misuse" as contained in Sec.147 c(2)(D) of the proposed bill.
