SUBJECT:

0F THE ENACTMENT OF S.274, THE NUCLEAR POWER PLANT SECURITY AND ANTI-TERRORISM ACT Yesterday's hearing on this proposed legislation strongly suggested tt one could reasonably expect that a bill will be enacted into law soon.

S.274, as you know, was passed by the Senate last year.

If enacted, we will be required to have implementing regulations in p' and, most likely, on a rather short schedule.

My understanding is thi staff has not initiated any action on a rulemaking proposal in anticil of the enactment of legislation.

I do not believe that the staff shot defer action any longer on preparing a proposed rule. After all, thi-legislation we proposed and supported as a keystone which would enhan' the efforts of nuclear reactor licensees to reduce the potential for reactor sabotage.

I believe that we should direct the staff to start work now on a prop implementing rule, with the objective of having the proposal publishe soon as possible after the date of enactment.
