MEPCRANDUM FOR: John G. Davis, Director Office of Nuclear Material Safety and Safeguards FRC$:' Patricia G. Norry, Director Office of Administration SUB[ECT: COMMENTS / CONCURRENCE ON PROPOSED RULE $ 73.57 ADM concurs in the proposed rule package subject to your consideration /incor-poration of the following conments and revisions:

1. Memorandum to the EDO, page 1, paragraph 2, item (3): For consistency with PL 99-399 and proposed rule, change "...ccmplete and correct infor-mation..." to "... complete, correct, and explain information...." 1 1
2. SEGY Paper, page 2, paragraph 1, item (3): same as 1 above.

3. SECY Paper, page 2, paragraph 2, last sentence: you may wish to consider providing alternative approaches to the Commission if the appropriations act is not amended or the continuing resolution does not contain the arrending language.

4 Proposed Rule, Supplementary Information, page 6, 1st full paragraph, last sentence: Certain NRC employees, e.g., resident or regional based inspectors / clerical aides, hava in the past reouired unescorted site access crior to the completion of the OPM investigation including the fingerprint check. It is not clear from the proposed rule whether the licensee tray provide unescorted site access prior to the ccmpletion of this check / grant of clearance for new NRC employees. NMSS may wish to clarify that portion of the rule dealing with unescorted access by NRC employees.

5. Preposed Rule, Supplementary Information, page 7,1st full paragraph: A clarifying statement may also be needed regarding the access status of licensee employees or others employed after publication of the rule, pending completion of the FBI fingerprint check.
6. Proposed Rule, page 12, paragraph (d)(1), after "...(Form FD-258)" insert

" supplied by the Commission...." This will ensure that licensees use fingerorint cards with the correct ORI nurrber needed for processing by the FBI. Also, after the Zip Code, insert Attention: Criminal History Check Section.

7 Proposed Rule, page 13, paragraph (3), secord sentence: For clarification, after "...shall submit s a yment" insert "with the application...."

8. Procosed Rule, page 14, paragraph (3): "Cbtained" is missoelled.
