Protection Section Meeting Summary: An Enforcement Conference was held at the NRC Region I office on February 13, 1987, to discuss the findings of NRC Inspection Report No.

70-687/87-01. This ins'pection report detailed circumstances associated with the apparent extremity exposure of a worker in excess of NRC quarterly limits during the third calendar quarter, 1985.

Several apparent violations of radiation protection regulations were also identified.

This meeting was attended by NRC and licensee management. The licensee presented background j

i and supplemental information concerning the exposures, provided results of a licensee investigation into the actual magnitude of the exposure, and described corrective actions.

This Enforcement Conference was held at the request of NRC Region I I

management to discuss the apparent violations identified during NRC Inspection 70-687/87-017he discussion at this conference focused on the apparent violations; their significance, cause, and licensee corrective actions, including status of commitments described in NRC Confirmatory Action Letter No. 87-01.

3.0 Discussion 4

Following introduction of personnel at the conference, NRC personnel presented a brief summary of their understanding of the events which lead to the apparent extremity exposure of a worker in excess of NRC quarterly j

limits.

3 After presenting this summary the licensee was asked to provide their perception of the report, any pertinent additional qualifying information, and the status of their corrective actions for those concerns raised in the Confirmatory Action Letter and Inspection Report 87-01.

4.0 Licensee Presentation The licensee initiated their presentation by indicating that the majority of violations described in NRC Report No. 87-01 were linked to the fund-amental overexposure concern. The licensee indicated a jurisdictional problem was involved and stated that they viewed the 21.453 rem cumulative extremity exposure, occurring during the third quarter, 1985, to have resulted from exposure to byproduct material and consequently to be sub-ject to New York State regulations. The New York State regulations allow exposure up to 25 rems in any consecutive 13 week period. Consequently, the licensee indicated they did not view the 21.453 rem exposure as an overexposure.

The licensee then provided a report to the meeting attendees which detailed their review of the manipulator hand repair operation (activity I

during which the worker received the 21.453 rem cumulative exposure) and associated exposures. This report included an evaluation of what typical exposures for performing the work should be and also included an analysis of the actual exposure received by the involved worker.

The licensee also detailed the corrective actions and improvement that have been instituted for the manipulator hand repair operation.

5.0 NRC Response and Conclusion NRC management indicated that the licensee's evaluation of the hand repairs operation and exposure received by the worker would be reviewed by the regional technical staff. NRC Region I management stated that the licensee would be informed of appropriate enforcement action addressing the overexposure of the worker at a later date.
