4 APPENDIX A NOTICE OF VIOLATION Cintichem, Incorporated Docket No.70-687 Tuxedo,-New York As a result of the inspection conducted on June 28-30, 1988, and in accordance with the "General Statement of Policy and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy, 1988), the following violations were identified:

A. 10 CFR 20.105(b)(1) and (2) states, in part, that, except as authorized by the Commission pursuant to paragraph (a) of this section, no licensee shall possess, use or transfer licensed material in such a manner as to create in any unrestricted area from radioactive material and othcr 4

sources of radiation in his possession: (1) radiation levels which, if an individuel we continuously present in the area, could result in his receiving a dose in excess of two millirems in any one hour, or (2) radiation levels which, if an individual were continuously present in the area, could result in his receiving a dose in excess of 100 millirems in

! any seven consecutive days, a Contrary to the above, on June 29, 1988, the radiation dose rate on the outside east wall of the Waste Storage Building was 8 millirem / hour which I- was in excess of two millirem / hour and would allow an individual, if

continuously present in the area, to receive a dose in excess of 100 l millirems in any seven consecutive days. The east wall of this building was in an unrestricted area in that access to the building was unimpeded 1- by fences from the north side of the licensee's property.

This is a Severity Level IV Violation (Supplement IV 0.2).

B. Section 4.1.5 "Posting Requirements" of Part 1 - Criteria of the NRC-approved license application states that criticality safety signs which indicate the SNM quantity limit and the current inventory shall be posted in areas where SNM is used or stored. The criticality sign posted i on Hot Cell No. 1 cuthorized a total of 3650 grams U-235 only in liquid form. Section 4.1.1 "Inventory Logs" of Part 1 - Criteria of the NRC-approved l license application states that a log of the running inventary of SNM

shall be maintained to demonstrate that the quantity in any area complies

! with the limits.

$ Contrary to the above, (1) on June 28, 1988, Hot Cell No. I contained one

uranium oxide batch can that held 163.18 grams U-235 as an oxide powder
and was not in liquid form; (2) on June 30, 1988, the log posted on the j

wall of the reactor facility tunnel indicated the presence of 179.08 grams U-235. There was actually 635.04 grams U-235 present in the tunnel.

This is a Severity Level IV Violation (Supple. tent VI 0).

Pursuant to the provisions of 10 CFR 20.201, Cintichem, Incorporated is hereby ,

required to submit to this office within thirty days of the date of the letter i which transmitted this Notice, a written statement or explanation in reply, l including: (1) the corrective steps which have been taken and the results  ;

achieved; (2) corrective steps which will be taken to avoid further violations; '

and (3) the date when full compliance will-be achieved. Where good cause is  :

shown, consideration will be given to extending this response time.
