She has authorized Consumers Organized for Defense of Environmental Safety, C .O.D.E .S . to act on her behalf in Nuclear Regulatory Commis-sion (NRC) proceedings regarding Pacific Gas and Electric Co. 's (PG&E) application for an amendment to increase the storage capacity of the spent fuel pools at Diablo Canyon.

I, Laurie McDermott, being first duly sworn, do depose and say as follows:

1, That I am a member of Consumers Organized for Defense of Environmental Safety, C.O.D.E.S.;

2. That I reside at 2116 Carpenter Canyon Road, San Luis Obispo, California and farm that property which has provided home and living to my family for six generations, located within the Emergency Evacuation Zone for Diablo Canyon Nuclear Power Plant with an Emergency Siren located on adjacent property;

3. That I have assisted workers, including my husband, at the Diablo Canyon Nuclear Power Plant, present evidence to the Nuclear Regulatory Commission and be-cause of this I am personally and accutely aware of the lack of resolution'and ac-tion on critical issues being investigated by the Office of Investigation (OI),

and Office of Inspection and Auditor (OIA), issues which are directly related to the Significant Hazard Issue of the Fuel Pond Reracking Application;

4. That I believe my Due Process and Equal Protection Rights under the Federal Constitution would be violated if I am denied an opportunity through C.O.D.E.S. to present contentions regarding the proposed Spent Fuel Pond Rerack-ing that would greatly expand the storage of high level radioactive waste at Diablo Canyon and I feel these issues seriously impact the health, livelihood and safety of me and my family by increased radioactive contamination during an ac-cident and excessive rates and taxes and other excessive funancial burdens neces-sitated by attempts to decontaminate and repair Diablo Canyon and the surrounding

• area after an accident;

5. That I hereby authorize Consumers Organized for Defense of Environmental Safety, C.O.D.E.S., to represent my interests before the Nuclear Regulatory Com-mission in the matter of the Application for an Amendment to Increase the Storage Capacity of the Spent Fuel Pools at the Diablo Canyon Nuclear Power Plant.
