OBJECTIONS OF PACIFIC GAS AND ELECTRIC COMPANY TO CERTAIN PROPOSED EXHIBITS OF INTERVENORS In accordance with the Appeal Board's Order dated October 1983 (Order at 4), Pacific Gas and Electric Company hereby objects to the following proposed exhibits of intervenors.

Preliminarily, in its Order dated August 16, 1983 the Appeal Board stated "The real issue in the reopened proceeding has, in effect, moved beyond the question of what deficiencies existed in the applicant's Diablo Canyon design quality assurance program to the question whether the applicant can demonstrate that the IDVP and the ITP verify the correctness of the Diablo Canyon design."

(Order at 6.)

Thus any evidence involving alleged design quality assurance deficiencies before November 1981, when the requirement for an IDVP was established, is not relevant or material to this proceeding.

Joint Intervenors' proposed Exhibit 128 is the so-called

" Case C" study prepared by the NRC's Office of Inspection and Enforcement, Division of Quality Assurance, Safeguards, and Inspection Programs. The " Case C" study is a working draft of 8310240174 831020 PDR ADOCK 05000275 O pop e

opinions and " findings" of a group looking at design QA prior to September 1981 and, therefore, is not relevant to this proceeding. In addition, the statements in the report are not subject to cross-examination, and this hearsay problem is heightened further by the fact that the document is a " working draft."

Joint Interver. ors' proposed Exhibit 129, the Reedy Report, deals exclusively with design QA prior to June 1978 and therefore is not relevant or material to this proceeding.

The Governor's proposed Exhibit 11, the INPO report, insofar as that document refers to operations and not design, is not relevant or material to this proceeding.

As required by the Appeal Board's Order PGandE's objections to the above-numbered proposed exhibits were discussed with counsel for the intervenors but no agreement was reached as to their admissibility.
