Re amendments to Facility Operating License Nos. DPR-80 and DPR-82 issued to Pacific Gas and Electric Company for operation of the Diablo Canyon Nuclear Power Plant (Docket Nos. 50-275 and 50-323):

The Sierra Club, Santa Lucia Chapter hereby enters with the Commission a Petition to Intervene in any hearing called by the Commission to hear arguments on the above mentioned amendments.

The Santa Lucia Chapter has more than one thousand members, the majority of whom live within the nuclear evacuation zone surrounding Diablo Canyon. Our long-standing concern with the safety of'the power plant facilities is a matter of record. The personal health and safety of our members and their f amilies are endangered by the proposed amendments in their present form.

4W Many of our members are property owners in San Luis Obispo County and also own and operate business enterprises in the County. We believe that these members would suffer considerable financial losses if the currently proposed amendments were to be approved.

Specifically, we maintain that significant controversy exists concerning Standards 1 and 3 (Federal Register Vol. 51, No.8, Jan 13, 1986, pp 1726, 1727). We do not agree with the evaluation of the licensee that the proposed reracking does not involve a significant increase in the consequences of a seismic event or in the consequences of a loss of spent fuel cooling. Nor do we agree with the licensee's finding that the proposed reracking does not involve a significant reduction in a margin of safety. In our opinion, all three considerations studied by the licensee involve degradations in the margin of safety for the spent fuel storage system.

Resolution of the Sierra Club, Santa Lucia Chapter, requesting a public hearing on the proposed amendments to Facility Operating Licenses issued to l

Pacific Gas and Electric Company for the expansion of spent fuel storage facilities at the Diablo Canyon Nuclear Power Plant, San Luis Obispo County, California:

Whereas, the United ' States Nuclear Regulatory Commission is considering issuance of amendments to the operating licenses of Diablo Canyon Nuclear Power plant which would increase the Unit 1 and Unit 2 spent fuel pool storage capacities from 270 to 1324 storage locations for each unit; and Whereas, section 132 of the Nuclear Waste Policy Act of 1982 requires that such additional storage at the site of a civilian nuclear power reactor be consistent with "the protection of the public health and safety, and the

. environment" and also be consistent with the " views of the population l

l surrounding such reactor"; and i

Whereas, controversy exists as to whether or not the proposed facility expansion invo lves a significant increase in the probability of an accident i

and/or consequences of an accident and also involves a significant reduction l in the margin of safety; and l

l Whereas, no attempt has been made to ascertain the views of the population surrounding the reactor; and Whereas, the property and personal safety of members of the Sierra Club, Santa Lucia Chapter, as well as the environment of San Luis Obispo County are seriously j eopardized by unsafe spent fuel storage facilities at Diablo Canyon.

Therefore, be it resolved that the Sierra Club, Santa Lucia Chapter, hereby requests the Nuclear Regulatory Commission to hold a public hearing in San Luis Obispo County to hear oral arguments on the proposed license amendments.
