In the past, behind the conclusions contained in 01 reports.

As a result of reviewing the conclusions in a recent 01 report, I discussed this issue with the Commission.

The Commission has unanimously adopted the policy that the staff'is not obligated to adopt the conclusions of 01.

This means that the staff must review OI reports to assure that there is sufficient support in the reports for staff actions.

However, we are to notify the Commission if we differ with Ol's conclusions.

I am assigning OELD the responsibility to promptly review each 01 report in which 01 concludes there was wrongdoing or where the report is particularly

- The. OELD analysis should address whether there is sufficient complex.

evidence in the report to support enforcenent action and should include any other issue which they believe should be brought to the attention of the responsible program offices.

OELD should also indicate if consideration

'l should be given to requesting further investigation.

I I expect that the program' office directors will notify OELD if they have significant differences with OELD's analysis. I will reevaluate this approach after six months.
