This is in response to your letter dated October 25, 1985, in which you appealed Mr. J. M. Felton's letter dated September 27, 1985, which denied _in_part your Freedom of Information Act (F0IA) request for documents concerning Amax, Inc.'s Parkersburg site. You specifically appealed the denial of two documents in Mr. Felton's September 27, 19Ls, letter.

Acting on your appeal, I have carefully reviewed the record in this case and have determined that one of the documents can now be released. The document listed on the enclosed Appendix A will be made available to you on February 28, 1986.

The document listed on the enclosed Appendix B has been referred to the Department of Energy for a classification review. As soon as we have the results of their review, we will make a determination as to which portions of the document can be released, and we will notify you.

! DOCKET NOS. 50-266 AND 50-301 j INSERVICE TESTING PROGRAM POINT BEACH NUCLEAR PLANT j We recently received a corporate visit and evaluation by the j Institute of Nuclear Power Operations (INPO). One of the areas i examined by INPO personnel during these evaluations is licensing 1 and regulatory matters. In the context of this evaluation, the j INPO personnel noted that our License Amendment Change Requests 1 Nos. 42 and 58 for the inservice pump and valve testing program, f which were filed on February 17, 1977 and November 27, 1978 for Point Beach Nuclear Plant Unit 1 and 2 respectively, had not yet been acted on by the Nuclear Regulatory Commission. Furthermore, i since shortly after those filings, we have been required by the j NRC to comply with both our existing Technical Specifications and our proposed inservice testing program. In those areas where conflicting requirements arise, we are required to comply i with the most restrictive requirements. This' direction was j most recently reiterated in'Mr. James R. Miller's letter dated 1 March 4, 1985. To further complicate noc'.ers, we have been required by the Commission's regulati5ns ,o submit revisions to

) even though the NRC evaluation of Ge tu Ginal submittal has j never been completed.

)4 Although we were informed last summer that the NRC expected to j complete its detailed review of our inservice testin~g program s and is' sue the appropriate license amendments by late 1985, this has not occurred. In fact, our contact with the Point. Beach Project j Manager during this'past week seems to indicate that a firm schedule

for is~ suing these license. amendments and approval of the Point J Beach Nuclear Plant inservic'e pump and valve testing program

During our meeting with Mr. Hugh Thompson- (then Director-Division of Licensing) on February 5, 1985, the resolution of the inservice inspection program was identified by your staff as a significant licensing issue. We urged Mr. Thompson at that meetin'g to do i whatever could be done to resolve this is' sue. We again request
i that you commit the necessary resources and address the policy issues that have been holding up the resolution of this' topic.

We understand that many other licensees are experiencing this same delay.

4 Please also be advised that, as a result of this continued delay in NRC action, certain interim relief granted pursuant to

10. CFR 50.59 (g) (6) (i) for several inservice testing requirements as identified in Mr. Miller's letter dated March 4, 1985, will i

expire on February 28, 1986, unless renewed by your staff. In the past, the NRC regional inspectors have taken a strict position on these interim reliefs and have indicated that citations could be issued for improper testing if the relief were allowed to expire. We request that these interim reliefs be extended

! until the inservice testing program has been approved and the appropriate License Amendments are issued. Mr. Colburn of your staff has advised us that he is working on such an extension.

We request that this' action be completed before the end of the month.

On January 24, 1986, I sent a letter to Mr. Hal Tucker, Chairman of the Babcock & Wilcox Owners Group urging that Group to take a leadership role in addressing the concerns and questions that have arisen regarding the Babcock & Wilcox reactor plant design. I indicated that the staff would work closely with the Owners Group to monitor their progress and assure that regulatory objectives are met.

On November 21, 1985, a loss of power and water hammer event at San Onofre Unit I has raised serious questions regarding the design, testing and maintenance of safety related check valves. I am concerned that this event has significant generic implications for all nuclear power plants and, by this letter am urging the General Electric Owners Group, as well as the other NSSS Owners Groups, to take prompt action, as appropriate, to preclude similar challenges to plant safety systems.

Enclosed is the NRC's report (NUREG-1190) on the San Onofre Unit 1 event. I anticipate your prompt attention to the check valve issue and ask that you arrange a meeting with the staff within about 30 days to discuss your views and intended actions. Contact Mr. Richard Vollmer, Deputy Director, Office of Inspection and Enforcement regarding any questions you may have and to arrange for your meeting.
