Nuclear Power, Inc. (CCANP), an Intervenor in this operating-license proceeding, requested that you be provided as a witness "to testify regarding representations made to [you] on February 21, 1982 by Mr. Jerome Goldberg concerning the nature of the Quadrex Report and the reasons for its comissioning, representations which CCANP contends were false and misleading and represented further evidence of HL&P's intent to deceive the NRC regarding the report."
In a Memorandum and Order dated June 24, 1985, which confirmed rulings made in a conference call on June 21, 1985, the Licensing Board determined that, under procedures set forth at 10 C.F.R. 9 2.720(h)(i),
a Licensing Board cannot direct a Comissioner to appear as a witness.
As a result, the Board denied CCANP's request for you to appear as a witness. A copy of this Memorandum and Order is attached for your information.
